Matrimonial Finances

Part of the divorce process will be deciding on what happens to any assets, money and most importantly, decisions regarding your children, if you have any.  This can be one of the most stressful aspects of the divorce or separation process and we have specialist divorce lawyers who can guide you through to options available to you, working with you and your family to minimise conflict where possible.  Whilst our aim will be to resolve issues amicably, through mediation or collaborative meetings, we have the experience and expertise to take firm legal action on your behalf if need be.  We can advise on all areas of finances and divorce including:

  • Ancillary Relief Procedure
  • Financial Agreements
  • Consent Orders
  • Clean Break
  • Court Orders and Financial Remedy Orders
  • Mediation and Resolution services

To speak to one of our divorce solicitors regarding matrimonial finances or consent orders confidentially you can contact our family law team on 023 9244 8100 or make an online enquiry.

Financial Agreements and Consent Orders

To set out the financial commitments between you and your former partner, including matters such as child maintenance and how debts will be paid moving forwards, you will need to have in place a financial agreement that sets out these obligations on divorce. Ideally, this will be carried out in the duration of the divorce proceedings so that when your divorce is finalised and if it has remained amicable, then the financial settlement and consent order may be agreed upon without having to go to court.

If there are no complicating factors and you are in complete agreement regarding your financial commitment, where you both want to be completely financially separate after your divorce, you could consider a ‘clean break’ financial agreement which completely dissolves any financial commitment you may have and your finances will be separate, with no further payments of spousal maintenance following the divorce. This is not suitable for everyone and there would be several factors to take into consideration. You should seek the advice of a specialist divorce solicitor to discuss all the available options open to you.

Court Orders

If an amicable agreement regarding your matrimonial finances cannot be reached, then our divorce solicitors will be able to provide you with practical advice regarding court orders. Regardless of whether we are representing you in court or negotiating on your behalf, we have the experience and expertise to face the most challenging legal issues.
