Harassment Claims against your Employer

Your employer has a legal obligation to ensure you are not subjected to acts of harassment carried out by their employees.  If you wish to bring an employment tribunal case against your employer for failing to act under these circumstances, you must seek legal advice as soon as possible as there is a time limit that requires you to act within three months of the last act of abusive treatment.

There is a mandatory Early Conciliation process you must follow before the time limit called Advisory, Conciliation and Arbitration Service ‘ACAS’. The ACAS process is compulsory for most harassment or bullying claims and must be completed to obtain a certificate from ACAS before you can lodge a claim with the Employment Tribunal. The process is there to try and resolve matters amicably without the need to go to court.
